תקנון ותנאי שימוש – SEVUÉ

מסמך זה (“התנאים”) מסדיר את השימוש באתר ובשירותים של SEVUÉ (“האתר”, “השירותים”). גישה לאתר, יצירת חשבון או ביצוע רכישה מהווים הסכמה לתנאים אלה ול[מדיניות הפרטיות](/policies/privacy-policy). אם אינך מסכים/ה – הימנע/י משימוש באתר.

## 2. כשירות ושימוש באתר
2.1. שימוש מיועד לבגירים לפי הדין החל במדינת מושבך. אם אפשרת לקטין להשתמש – האחריות לכך עליך.  
2.2. עליך למסור מידע מדויק, מלא ועדכני ולשמור בסודיות על פרטי החשבון. כל פעולה מחשבונך באחריותך.

## 3. כריתת חוזה והזמנות
3.1. שליחת הזמנה היא הצעת רכישה בלבד. חוזה נכרת רק לאחר אישור הזמנה וקבלת תשלום תקין.  
3.2. אנו רשאים לבטל/לדחות הזמנה (לרבות בשל חוסר מלאי, שגיאת תמחור, חשד להונאה). במקרה ביטול יוחזר הסכום ששולם בפועל.  
3.3. מבצעים/קופונים כפופים לתנאים המתפרסמים לידם בזמן אמת.

## 4. מוצרים, הצגות ותיקוני טעויות
4.1. אנו משתדלים להציג תמונות/תיאורים מדויקים; ייתכנו הבדלי צבע/מראה עקב הגדרות מסך/מכשיר.  
4.2. תיאורים, מחירים וזמינות עשויים להתעדכן ללא הודעה מוקדמת. טעות סבירה ניתנת לתיקון גם לאחר הזמנה.

## 5. מחירים, מטבע ומסים
5.1. המחיר המחייב הוא המחיר בעמוד התשלום במועד ההזמנה, בצירוף/בניכוי מבצעים, מסים, דמי משלוח/טיפול.  
5.2. הזמנות בינלאומיות עלולות לחוב במכסים/מסי יבוא/היטלים במדינת היעד – חבות ועלות על הלקוח/ה בלבד.

## 6. תשלומים וסליקה
6.1. תשלומים מעובדים בידי ספקי סליקה מורשים; אנו איננו שומרים מספרי כרטיס מלאים.  
6.2. אנו רשאים לבקש אימות זהות/אמצעי תשלום; אי-עמידה עשויה לעכב או לבטל הזמנה.

## 7. משלוחים, אספקה והעברת סיכון
7.1. מועדי אספקה הינם משוערים בלבד. עיכובים של חברת שילוח/מכס/נסיבות חיצוניות אינם בשליטתנו.  
7.2. הסיכון למוצר עובר ללקוח/ה עם מסירת החבילה לחברת השילוח, אלא אם הדין החל קובע אחרת.  
7.3. אחריות לפרטי משלוח שגויים/חסרים – על הלקוח/ה. משלוח חוזר/החלפה עשויים לחייב תשלום נוסף.

## 8. ביטולים, החזרות וזיכויים
8.1. מדיניות ההחזרות והביטולים מצויה כאן: **[/policies/refund-policy](/policies/refund-policy)** ומהווה חלק בלתי נפרד מהתנאים.  
8.2. לקוחות ישראל: עסקת מכר מרחוק כפופה לחוק הגנת הצרכן, לרבות זכות ביטול בתוך 14 ימים מקבלת המוצר, בכפוף להחזרה באריזה מקורית, ללא שימוש וללא פגיעה בסחורה, ובהתאם לחריגים שבדין (למשל מוצר בהתאמה אישית). זכויות יתר לאוכלוסיות מוגנות יכובדו ככל שהן חלות.  
8.3. החזר יינתן לאמצעי התשלום המקורי; ייתכן ניכוי דמי משלוח/עלות ישירה/דמי ביטול לפי מדיניות ובהתאם לדין.

## 9. תוכן משתמשים וביקורות
9.1. פרסום ביקורת/תמונה/תוכן מצהיר כי הינך בעל הזכויות וכי התוכן חוקי ואינו פוגע בצד ג’.  
9.2. אתה מעניק ל-SEVUÉ רישיון עולמי, בלתי-בלעדי וללא תמלוגים להשתמש/להציג/לשכפל/לערוך/להפיץ את התוכן לצורכי האתר והשיווק, בכפוף למדיניות הפרטיות.

## 10. קניין רוחני
כל סימנים מסחריים, לוגואים, תמונות, עיצובים, טקסטים וקבצים באתר – בבעלות SEVUÉ או ברישיון. אין להעתיק/לשכפל/להפיץ/ליצור יצירות נגזרות ללא אישור כתוב מראש.

## 11. שימושים אסורים
חל איסור על הפרת זכויות, העלאת קוד זדוני, עקיפת מנגנוני אבטחה, סריקה/כרייה אוטומטית ללא רשות, התחזות, הונאה, ניצול באגים ושליחת דואר זבל/פישינג.

## 12. צדדים שלישיים וקישורים
האתר פועל על פלטפורמות ושירותים חיצוניים (כגון Shopify, סליקה, לוגיסטיקה, דיוור). שירותים אלה מסופקים “כמות שהם” ואיננו אחראים לתכנים/זמינות/פרטיות של אתרים אלה. העסקאות באתר הן מול SEVUÉ בלבד.

## 13. פרטיות ועוגיות
עיבוד מידע אישי לפי **[/policies/privacy-policy](/policies/privacy-policy)**. שימוש באתר מהווה הסכמה לשימוש בעוגיות בהתאם ל-**[/pages/cookie-preferences](/pages/cookie-preferences)**.

## 14. זמינות ושינויים טכניים
אין התחייבות לזמינות רציפה/ללא שגיאות. ייתכנו תחזוקה/שדרוגים/הפסקות.

## 15. כתב ויתור (Disclaimer)
השירותים והמוצרים מוצעים “As is” ו-“As available”, ללא אחריות מכל סוג במידה המרבית המותרת בדין (לרבות התאמה למטרה מסוימת, סחירות, אי-הפרה, דיוק/זמינות).

## 16. הגבלת אחריות
במירב ההיקף המותר בדין:  
16.1. לא נהיה אחראים לנזקים עקיפים/תוצאתיים/מיוחדים/עונשיים, אובדן רווח/מוניטין/נתונים.  
16.2. אחריותנו הכוללת לכל עילה תוגבל לגובה הסכום ששילמת בפועל עבור המוצר/השירות הרלוונטי **או ₪500**, לפי הגבוה.  
16.3. אין מגבלה זו גורעת מאחריות שלא ניתן להגביל בדין. זכויות צרכניות קוגנטיות אינן נפגעות.

## 17. שיפוי
הנך מתחייב/ת לשפות את SEVUÉ, עובדיה ונציגיה בגין טענות/הפסדים/הוצאות (לרבות שכר טרחה) הנובעים מהפרת התנאים, שימוש בלתי חוקי או פגיעה בזכויות צדדי ג’ – במידה המותרת בדין.

## 18. כוח עליון
לא נהיה אחראים לאי-קיום/עיכוב עקב אירועים שאינם בשליטתנו הסבירה (כוח עליון), לרבות תקלות ספקים, שריפות, מגפות, סנקציות, השבתות, כשלים תקשורתיים ועוד.

## 19. שינוי תנאים
אנו רשאים לעדכן תנאים אלה מעת לעת; “עודכן לאחרונה” ישקף את המועד. המשך שימוש באתר לאחר שינוי מהווה הסכמה לנוסח המעודכן.

## 20. דין ושיפוט
הדין החל: חוקי מדינת ישראל (ללא כללי ברירת דין). סמכות שיפוט ייחודית בישראל. אם דין מדינת מושבך מעניק הגנות קוגנטיות – אין באמור לגרוע מהן.

## 21. שונות
פסלות חלקית אינה פוגעת ביתר ההוראות; אי-אכיפה חד-פעמית אינה ויתור; אין להסב זכויות ללא הסכמה כתובה; לנו נתונה זכות המחאה במסגרת עסקית/תאגידית; הנוסח המחייב הוא בעברית.

These Terms of Service (“Terms”) govern your access to and use of SEVUÉ’s website and services (“Services”). By accessing the website, creating an account, or placing an order, you agree to these Terms and to our [Privacy Policy](/policies/privacy-policy). If you do not agree, do not use the Services.

## 2. Eligibility & account
You must be of legal age to use the Services. If you allow minors to use the Services, you are responsible for their use. You must provide accurate and up-to-date information and keep your account credentials confidential. You are responsible for all activity under your account.

## 3. Contract formation & orders
Submitting an order is an offer to purchase. A binding contract is formed only after we accept the order and receive valid payment. We may cancel or refuse any order (e.g., out of stock, pricing error, suspected fraud). If we cancel, we will refund amounts actually paid.

## 4. Products, display & corrections
We strive for accurate descriptions and images, but colors/appearance may vary due to device/display settings. Descriptions, prices, and availability may change without notice. We may correct reasonable errors even after an order is placed.

## 5. Prices, currency & taxes
The price that applies is the one shown at checkout at the time of purchase, plus/minus promotions, taxes, shipping/handling where applicable. International orders may incur customs, duties, and import taxes in the destination country, which are the customer’s responsibility.

## 6. Payments
Payments are processed by authorized payment providers. We do not store full card numbers. We may request identity/payment verification; failure to comply may delay or cancel an order.

## 7. Shipping, delivery & risk
Delivery times are estimates only. Delays caused by carriers/customs/third parties are outside our control. Risk of loss passes to you when the package is handed to the carrier unless mandatory law provides otherwise. Incorrect/incomplete addresses are your responsibility and re‑shipping may incur fees.

## 8. Cancellations, returns & refunds

For Israeli consumers: remote sales are subject to the Israeli Consumer Protection Law, including a 14‑day cancellation window from receipt (subject to return in original packaging, unused/undamaged) and statutory exceptions (e.g., custom-made items). Refunds are issued to the original payment method and may exclude shipping/handling or statutory cancellation fees, as permitted by law.

## 9. User content & reviews
By posting reviews or content, you represent you own the rights and that the content is lawful and non‑infringing. You grant SEVUÉ a worldwide, non‑exclusive, royalty‑free, perpetual license to use, display, reproduce, edit, and distribute such content for site and marketing purposes, subject to our Privacy Policy.

## 10. Intellectual property
All trademarks, logos, images, designs, texts and files on the site are owned by SEVUÉ or licensed to us. You may not copy, reproduce, distribute, or create derivative works without prior written consent.

## 11. Prohibited uses
No unlawful use, rights infringement, malware, security circumvention, unauthorized scraping/mining, impersonation, fraud, exploitation of bugs, or sending spam/phishing.

We rely on third‑party platforms (e.g., Shopify, payment, logistics, email). They are provided “as is”; we are not responsible for their content/availability/privacy. Transactions on this site are with SEVUÉ only.

## 13. Privacy & cookies

## 14. Availability
We do not warrant uninterrupted or error‑free availability. Maintenance, upgrades, or outages may occur.

Services and products are provided “As is” and “As available,” without warranties of any kind to the maximum extent permitted by law (including merchantability, fitness for a particular purpose, non‑infringement, accuracy, or continuous availability).

## 16. Limitation of liability
To the maximum extent permitted by law:  
We will not be liable for indirect, consequential, special, punitive damages, or loss of profits/goodwill/data. Our total liability for any claim will not exceed the amount you actually paid for the relevant product/service **or NIS 500**, whichever is higher. Nothing limits liability that cannot be limited under applicable law; mandatory consumer rights remain unaffected.

## 17. Indemnity
You agree to indemnify and hold SEVUÉ, its employees and agents harmless from claims/losses/costs (including legal fees) arising from your breach of these Terms, unlawful use, or third‑party rights violations, to the extent permitted by law.

## 18. Force majeure
We are not liable for failure/delay due to events beyond our reasonable control, including supplier failures, fires, epidemics, sanctions, strikes, or communication failures.

## 19. Changes to Terms
We may update these Terms from time to time; the “Last updated” date reflects the current version. Continued use after changes constitutes acceptance.

## 20. Governing law & jurisdiction
These Terms are governed by the laws of the State of Israel (without regard to conflict‑of‑laws rules). Exclusive jurisdiction lies with competent courts in Israel. If the law of your residence grants mandatory consumer protections, those remain unaffected.

## 21. Miscellaneous
Severability, no waiver, no assignment without our consent (we may assign in connection with business transactions). The Hebrew version prevails; translations are for convenience only.
